Agreement to Terms

By accessing or using Lavoix ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Lavoix is an AI-powered French language learning application that provides:

  • Interactive conversation practice with Léah, our AI French tutor
  • Learning paths and lessons
  • Scenario-based conversation practice (e.g., ordering at a café, booking a hotel)
  • Flashcard systems for vocabulary building
  • Spaced-repetition reviews of grammar and vocabulary you have practiced
  • Real-time voice conversation features
  • Progress tracking and performance analytics

Eligibility

You must be at least 13 years old to use Lavoix. By using this Service, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years old, you confirm that you have obtained parental or guardian consent to use this Service.

Account Registration

Creating an Account

To access Lavoix, you must create an account by providing:

  • A valid email address (used either for passwordless email magic-link sign-in, or via Google Sign-In if you choose to authenticate with Google)
  • Acceptance of these Terms and our Privacy Policy

Account Security

Lavoix uses passwordless authentication via email verification codes (magic links) or Google Sign-In. There are no passwords to manage.

You are responsible for:

  • Maintaining access to your email account (used for authentication)
  • All activities that occur under your account
  • Notifying us immediately of unauthorized access or security breaches

You may not:

  • Share your account with others
  • Use another person's account without permission
  • Create multiple accounts for fraudulent purposes

Acceptable Use Policy

Permitted Uses

You may use Lavoix for:

  • Personal French language learning
  • Educational and self-improvement purposes
  • Practicing conversation skills with our AI tutor

Prohibited Uses

You may NOT use Lavoix to:

  • Violate any laws or regulations
  • Harass, abuse, or harm others
  • Transmit spam, malware, or malicious code
  • Attempt to reverse engineer, decompile, or hack the Service
  • Scrape, data mine, or extract data without authorization
  • Impersonate others or misrepresent your identity
  • Use the Service for commercial purposes without written permission
  • Share, distribute, or sublicense access to the Service
  • Post or transmit content containing:
    • Hate speech, discrimination, or violence
    • Sexually explicit material
    • Illegal content or activities
    • Content that infringes intellectual property rights

Content Moderation: Conversations are processed through third-party AI services (see our Privacy Policy for a complete list) which may have their own content moderation policies. Prohibited content may be automatically flagged or blocked by these services.

Consequences of Violation

Violation of this Acceptable Use Policy may result in:

  • Warning and request to cease violation
  • Temporary suspension of your account
  • Permanent termination of your account
  • Legal action if necessary

Intellectual Property Rights

Lavoix's Intellectual Property

All content and materials available on Lavoix, including but not limited to:

  • Software, code, and algorithms
  • Text, graphics, logos, and branding
  • Lesson content, flashcards, and learning materials
  • Audio recordings and AI-generated content
  • User interface design and layout

...are the exclusive property of Lavoix or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of:

  • Your conversation transcripts (note: audio recordings are not stored)
  • Your learning progress data
  • Flashcards and learning materials you create

However, by using Lavoix, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of:

  • Providing and improving the Service
  • Analyzing learning patterns for educational research (anonymized)

Important: Your conversation data is processed by third-party AI providers subject to their respective terms of service and privacy policies. See our Privacy Policy for a complete list of providers and details about data handling.

You can delete your account and all associated data directly from the app under Settings. You can also contact support@lavoix.app.

Third-Party Content

Lavoix uses third-party content and services:

  • Grammar lessons adapted from Tex's French Grammar (Carl Blyth et al., Center for Open Educational Resources and Language Learning, University of Texas at Austin). Full attribution at Credits.
  • Avatar character created by ersanakpinarr (CC BY license)
  • Other third-party libraries and assets as documented in our app

Feedback and Suggestions

If you submit feedback, ideas, suggestions, or proposals about Lavoix (whether through support emails, conversations, or any other channel), you grant us a worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to use, implement, modify, and incorporate that feedback into the Service without compensation, attribution, or obligation to you. You retain any intellectual property rights you may have in the underlying ideas, but we are free to use the feedback for any purpose related to developing and improving Lavoix.

Subscriptions and Billing

Free Trial

Lavoix offers a free trial consisting of 2 free sessions (such as a grammar lesson or conversation scenario) to help you experience the Service before subscribing. After completing your trial, you must purchase a subscription to continue using Lavoix.

Paid Subscriptions

Paid subscription plans include:

  • 300 minutes of conversation practice with Léah per month
  • Full access to learning paths and lessons
  • Flashcard creation and review
  • Progress tracking and analytics

Billing Terms

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed securely through Stripe (PCI-DSS compliant)
  • Prices are subject to change with 30 days' notice
  • You authorize us to charge your payment method for recurring subscriptions until cancelled
  • Your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel before renewal. You can cancel anytime from your account settings
  • All prices are in USD (or your local currency as displayed at checkout)

Cancellation

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of your current billing period
  • You will retain access to paid features until the end of the billing period
  • All subscription fees are non-refundable in all circumstances, except (a) where required by applicable consumer protection law, including the EU/EEA 14-day right of withdrawal described below, (b) where Lavoix discontinues the Service to paid subscribers (see Service Modification and Discontinuation), or (c) where Lavoix elects to issue a refund at its sole discretion
  • If you cancel mid-billing cycle, you will not receive a pro-rated refund (subject to the EU/EEA 14-day right of withdrawal described below)

EU/EEA 14-Day Right of Withdrawal

If you are a consumer located in the European Union or European Economic Area, you have a 14-day right of withdrawal under the EU Consumer Rights Directive (2011/83/EU). You may cancel your subscription for any reason within 14 days of your initial purchase and receive a full refund of the amount paid, by contacting support@lavoix.app. No reason is required.

This right applies to your initial purchase of a subscription. It does not apply to subsequent automatic renewals (the renewal itself is a continuation of an existing subscription, not a new distance contract).

To exercise this right, contact us at support@lavoix.app within 14 days of your purchase. We will process the refund to your original payment method within 14 days of receiving your withdrawal request, in accordance with Article 13 of the Consumer Rights Directive.

The right of withdrawal applies in addition to, and does not limit, any rights you have under your local consumer protection law (including, where applicable, similar withdrawal rights under UK consumer law).

Usage Limits and Fair Use

Speaking Time Allocation

  • Paid subscribers receive a monthly allocation of conversation time (currently 300 minutes per month)
  • Unused time does not roll over to the next month
  • Usage resets on your billing date

Fair Use Policy

  • We reserve the right to set, adjust, or enforce usage limits to ensure service quality for all users
  • Individual usage limits may be adjusted at our discretion based on usage patterns
  • We will notify users if their limit is adjusted

Exceeding Limits

  • If you exceed your monthly allocation, access to conversations may be temporarily restricted until your next billing cycle
  • You may contact support to discuss limit adjustments

Privacy and Data Protection

Your use of Lavoix is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using Lavoix, you consent to the data practices described in our Privacy Policy.

Disclaimers and Limitations of Liability

Service "As Is"

Lavoix is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Fitness for a particular purpose
  • Non-infringement of third-party rights

AI-Generated Content

All learning content in Lavoix (including lessons, grammar explanations, exercises, flashcards, conversation responses, and pronunciation guidance) is generated by artificial intelligence (AI) and large language models (LLMs).

By using Lavoix, you acknowledge and accept that AI-generated content may:

  • Contain grammatical errors, incorrect vocabulary, or inaccurate translations
  • Provide wrong or misleading pronunciation guidance
  • Include factual inaccuracies about French language rules or usage
  • Generate culturally inappropriate or contextually incorrect phrases
  • Produce unexpected, nonsensical, or inappropriate responses
  • Contain errors that native French speakers would not make

No Guarantee of Accuracy: We make NO warranties or representations regarding the accuracy, completeness, or reliability of any AI-generated content. All content is provided for educational entertainment purposes only.

Not Professional Instruction: Lavoix is NOT a substitute for:

  • Instruction by qualified French teachers or native speakers
  • Professional language certification programs
  • Academic language courses
  • Human tutoring or classroom instruction

User Responsibility: You are solely responsible for:

  • Verifying any information learned through Lavoix before relying on it
  • Seeking qualified instruction if accuracy is important for professional, academic, or official purposes
  • Understanding that mistakes in AI-generated content are inevitable

No Reliance for Critical Purposes: Do NOT rely on Lavoix for:

  • Professional translation or interpretation
  • Academic exams or certifications (DELF, DALF, TCF, etc.)
  • Legal, medical, or official document translation
  • Business communications where accuracy is critical

By using Lavoix, you expressly acknowledge that you understand and accept these limitations of AI-generated educational content.

Reliance on Third-Party AI Providers: Lavoix relies on third-party AI providers (listed in our Privacy Policy) to generate educational content. The quality, availability, latency, and behavior of those providers are outside our control. Variations, outages, regressions, or changes in third-party AI provider behavior, including content quality differences between providers, model updates, or temporary unavailability, are not breaches of these Terms. We may switch providers at any time without notice.

Limitation of Liability

To the maximum extent permitted by law, Lavoix and its affiliates shall NOT be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from use or inability to use the Service
  • Aggregate cap: Lavoix's aggregate liability for any and all claims arising from or relating to these Terms or the Service, regardless of legal theory and regardless of whether such damages were foreseeable, shall not exceed the amount you paid Lavoix in the 12 months preceding the event giving rise to the claim. Some jurisdictions do not permit such caps; this provision applies to the maximum extent permitted by applicable law and does not limit any rights that cannot be excluded by contract.
  • Any incorrect information, grammar, vocabulary, or pronunciation learned through the Service
  • Failed exams, certifications, or assessments based on content learned through Lavoix
  • Embarrassment, misunderstanding, or miscommunication resulting from language errors
  • Any professional, academic, or personal consequences from relying on AI-generated content

Educational Outcomes: We make no guarantees regarding your learning outcomes, language proficiency improvement, or ability to pass any exam or certification. Results vary by individual and depend on factors outside our control.

Some jurisdictions do not allow these limitations, so they may not apply to you.

Time Limitation on Claims

Any claim or cause of action arising from or relating to these Terms or your use of the Service must be filed within one (1) year of the event giving rise to the claim, except where applicable law requires a longer period or prohibits such limitation.

Indemnification

You agree to indemnify, defend, and hold harmless Lavoix, its affiliates, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable laws
  • Any claims related to your misuse of the Service
  • Your reliance on AI-generated content for professional, academic, or official purposes contrary to the disclaimers in these Terms

Termination

Your Right to Terminate

You can delete your account at any time from Settings in the app. You can also contact support@lavoix.app. Upon deletion, your data is permanently removed from our systems within 30 days (see our Privacy Policy for details). If you have an active subscription, it will be canceled immediately with no refund.

Our Right to Terminate

We may suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Harm or threaten other users or the Service
  • Fail to pay subscription fees

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account data in accordance with our Privacy Policy
  • Provisions of these Terms that should survive termination will remain in effect

Service Modification and Discontinuation

Our Right to Modify

We reserve the right to modify, update, or change any aspect of the Service at any time. Material changes that significantly reduce functionality will be communicated via email or prominent notice. We may also modify the Service for security, legal compliance, or technical reasons without prior notice; such modifications do not constitute a breach of these Terms regardless of their impact on functionality.

Our Right to Discontinue

We may discontinue Lavoix, in whole or in part, at any time for any reason.

For Paid Subscribers:

  • We will provide at least 30 days' written notice before discontinuing the Service
  • You will receive a pro-rata refund of any prepaid subscription fees for the unused portion of your subscription period
  • Refunds will be processed to your original payment method within 30 days

For Free Users:

  • We may discontinue the Service at any time without prior notice
  • No refunds apply (the Service is free)

Exceptions: We may discontinue or suspend the Service with shorter or no notice if necessary to:

  • Maintain the security, availability, or performance of the Service
  • Comply with legal requirements or court orders
  • Prevent fraud or illegal activity
  • Protect intellectual property rights

Data Export

Upon discontinuation, you will have a reasonable period (minimum 30 days from notice) to export your data. Instructions for data export will be provided in the discontinuation notice.

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

Informal Resolution

Before filing a legal claim, you agree to contact us at support@lavoix.app to seek informal resolution. We will attempt to resolve disputes within 30 days.

Legal Venue

Any legal action or proceeding arising from these Terms or your use of Lavoix shall be brought exclusively in the courts of Ontario, Canada. You consent to the jurisdiction of such courts and waive any objections to venue.

No Class Actions

To the maximum extent permitted by applicable law, you agree to resolve any disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

Jurisdictional Note: This waiver does not apply where prohibited by law. This includes, but is not limited to, residents of the European Union/EEA, Quebec, other Canadian provinces where such waivers are unenforceable, Australia, and any other jurisdiction where class action waivers are prohibited or unenforceable under applicable consumer protection or procedural law. Nothing in these Terms limits any rights you have under mandatory consumer protection laws that cannot be waived by contract.

Changes to Terms

We may modify these Terms at any time. When we make changes, we will update the "Last Updated" date and prompt you to review and accept the updated Terms before continuing to use the Service. If you do not accept the updated Terms, you may terminate your account in accordance with the Termination section above.

Miscellaneous

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lavoix.

Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, pandemic, civil unrest, government action, internet or telecommunications failures, third-party service outages (including AI providers, hosting providers, payment processors, and content delivery networks), denial-of-service attacks, or any failure of public infrastructure. During a force majeure event, our obligations are suspended for the duration of the event. The event does not relieve you of your obligation to pay subscription fees during the affected period, and we are not obligated to provide refunds or service credits for downtime caused by such events, except where applicable consumer protection law requires otherwise.

No Third-Party Beneficiaries

These Terms are between you and Lavoix only. No third party has any right to enforce any provision of these Terms.

Survival

The following sections survive termination of your account or these Terms: Intellectual Property Rights, Feedback and Suggestions, Disclaimers and Limitations of Liability, Time Limitation on Claims, Indemnification, Privacy and Data Protection, Dispute Resolution, and this Miscellaneous section.

Notices

Notices to you will be sent to the email address associated with your account or posted in the app. You are responsible for keeping your contact email current. Notices to us must be sent to support@lavoix.app.

Electronic Communications

By creating an account, you consent to receive communications from us electronically (by email or in-app notice). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

No Waiver of Mandatory Statutory Rights

Nothing in these Terms operates to exclude or limit any right you have under applicable consumer protection, data protection, or other mandatory law that cannot be excluded or limited by contract. Where any provision of these Terms is held to conflict with such mandatory law, the provision is modified to the minimum extent necessary to comply with that law and the remaining provisions remain in effect.
